OVERVIEW

Welcome to AlginatePlus. The terms "we", "us" and "our" refer to [AlginatePlus], a company registered in England and Wales trading as AlginatePlus. We operate this store and website, including all related information, content, features, tools, products and services (the "Services"). AlginatePlus is powered by Shopify, which enables us to provide the Services to you.

The terms and conditions below, together with any policies referenced in them, describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

IF YOU ARE A CUSTOMER IN THE UNITED STATES, THESE TERMS REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS, UNLESS YOU OPT OUT. SEE SECTION 14.

If you are a customer in the United Kingdom, Section 14 does not require arbitration and does not affect your right to bring a claim in court.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.

Nothing in these Terms affects your statutory rights as a consumer where those rights cannot lawfully be excluded or limited.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding contract.

To use the Services, including browsing our online store or purchasing any of the products we offer, you may be asked to provide certain information such as your email address, billing, payment, and shipping details. You represent and warrant that all information you provide is correct, current and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or licence your account to any other person.

SECTION 2 — HEALTH INFORMATION AND INTENDED USE

AlginatePlus is a food supplement. It is not a medicine and it is not a medical device, and it has not been assessed by any regulator for the treatment or prevention of any condition.

Always read the label and any enclosed leaflet before use, and follow the stated dosage instructions.

Content published on our Services — including product pages, articles, guides, customer stories, and educational material, whether or not authored or reviewed by a healthcare professional — is provided for general information only. It is not medical advice and is not a substitute for consultation with a qualified healthcare professional who knows your circumstances. Where content is authored or reviewed by a healthcare professional, that person is acting in an educational capacity on behalf of AlginatePlus and is not entering into a clinician-patient relationship with you.

Do not stop, start, or alter any prescribed medication on the basis of anything on our Services. Speak to your doctor or pharmacist before use if you are pregnant or breastfeeding, are taking prescription medication, have a diagnosed medical condition, or are on a restricted-sodium diet.

If your symptoms persist or worsen, or if you experience difficulty swallowing, unintentional weight loss, persistent vomiting, or chest pain, seek medical advice rather than continuing to self-treat.

Individual results vary. Testimonials reflect the experience of the individual concerned and are not typical or guaranteed. Where a contributor has received free product, payment, or any other incentive, that connection is disclosed alongside their statement.

SECTION 3 — OUR PRODUCTS

We have made every effort to represent our products accurately. Colours and product appearance may differ from how they appear on your screen due to your device type and settings.

All product descriptions are subject to change at any time at our discretion. We reserve the right to discontinue any product at any time and to limit the quantities of any product we offer to any person, geographic region or jurisdiction, on a case-by-case basis. Some products may not be available in all jurisdictions.

SECTION 4 — ORDERS

When you place an order, you are making an offer to purchase. AlginatePlus reserves the right to accept or decline your order at its discretion. Your order is not accepted, and no contract is formed, until we confirm dispatch. Payment being taken does not itself constitute acceptance.

Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests once an order has entered processing. This does not affect your statutory cancellation rights.

If we do not accept, change, or cancel an order, we will attempt to notify you using the email address, billing address, or telephone number provided at the time of order.

In the event of an obvious pricing or description error, we are not obliged to supply at the incorrect price and will contact you to confirm whether you wish to proceed at the correct price or cancel.

Your purchases are subject to return, refund, or exchange in accordance with our Refund Policy, available at https://www.alginateplus.com/policies/refund-policy and with your statutory rights.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 5 — PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed and will be set out in your order confirmation email.

UK orders: Prices are shown inclusive of VAT where applicable. Delivery charges are shown separately at checkout before you complete your order.

US orders: Prices are shown in [USD / GBP converted at checkout]. Applicable state and local sales tax is calculated at checkout where we are required to collect it.

Import duties on US orders: Orders to the United States are shipped from the United Kingdom. All applicable import duties, tariffs and customs charges are calculated and included in the price you pay at checkout. You will not be asked for any further payment on delivery. If a carrier does contact you requesting additional import charges on a delivered or in-transit order, please contact us at hello@alginateplus.com before paying and we will resolve it with the carrier.

We may from time to time run promotions governed by their own terms and conditions. Where those terms conflict with these Terms, the promotion terms govern for that promotion.

You agree to provide current, complete and accurate purchase, payment and account information, and to promptly update it — including your email address and payment card details — so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the payment card information you provide is true, correct and complete, (ii) you are authorised to use that card for the purchase, (iii) charges incurred by you will be honoured by your card issuer, and (iv) you will pay charges incurred at the posted prices, including shipping and handling charges and all applicable taxes.

SECTION 6 — SHIPPING AND DELIVERY

All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control.

Risk of loss and damage passes to you on delivery to the address you provide, or to a person identified by you as authorised to receive the goods.

If your package is delayed, lost, damaged, or marked as delivered but not received, contact us at hello@algionateplus.com with your order number and tracking details. We may ask you to check with the carrier or confirm your shipping address, but our support team will review the situation and help you find the best available resolution.

SECTION 7 — ELECTRONIC COMMUNICATIONS AND SMS MARKETING

(a) Electronic communications. You consent to receive electronic communications from AlginatePlus, either by email to the address listed on your account or by communications posted on the Site. You acknowledge that any such communication satisfies any legal requirement that communications from us be in writing.

(b) Marketing email. We send marketing email only where you have consented, or where you are an existing customer and the law permits us to contact you about similar products. You may withdraw consent at any time using the unsubscribe link in any marketing email or by contacting hello@algionateplus.com . Withdrawing marketing consent does not stop transactional messages about your orders.

(c) SMS and text messaging. By providing your telephone number and affirmatively opting in, you consent to receive transactional, promotional and marketing text messages from or on behalf of AlginatePlus. Consent to marketing texts is not a condition of purchase. Message frequency may vary, and message and data rates may apply. Carriers are not liable for delayed or undelivered messages. You may withdraw consent at any time by replying "STOP" to any message, or "HELP" for assistance.

SECTION 8 — INTELLECTUAL PROPERTY

Our Services, including all trade marks, brands, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement of them, are owned by AlginatePlus, its affiliates or licensors, and are protected by UK, US and international intellectual property law.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent.

Except as expressly provided, nothing in these Terms grants you any licence or right under any patent, trade mark, copyright or other intellectual property of AlginatePlus, Shopify, or any third party. All rights not expressly granted are reserved.

Reference to any third-party product or brand does not imply affiliation with or endorsement by that party.

SECTION 9 — REVIEWS AND USER CONTENT

If you submit a review, photograph, testimonial or other content to us or to the Services, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display that content in connection with our business, including in advertising, unless you tell us otherwise in writing.

You confirm that any content you submit is your own honest opinion and experience, that you have the right to submit it, and that it does not infringe anyone's rights.

We may remove content that is unlawful, abusive, off-topic, or that makes medical claims we cannot substantiate. We do not remove or refuse to publish reviews on the basis that they are negative or unfavourable, and we do not offer compensation in exchange for positive reviews.

SECTION 10 — OPTIONAL TOOLS AND THIRD-PARTY LINKS

You may be provided with access to third-party tools as part of the Services, which we neither monitor nor control. We provide access to such tools "as is" and "as available" without warranties, representations, conditions or endorsement of any kind, and we have no liability arising from your use of them.

The Services may contain links to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites. If you leave the Services to access them, you do so at your own risk. Complaints or questions regarding third-party products and services should be directed to that third party.

SECTION 11 — RELATIONSHIP WITH SHOPIFY AND PRIVACY

AlginatePlus is powered by Shopify, which enables us to provide the Services to you. Any sale or purchase you make in our store is made directly with AlginatePlus. You acknowledge that Shopify is not responsible for any aspect of any sale between you and AlginatePlus, including any injury, damage or loss resulting from purchased products. To the extent permitted by law, you release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with AlginatePlus.

All personal information we collect through the Services is subject to our Privacy Policy, available at https://www.alginateplus.com/policies/privacy-policy, which is incorporated into these Terms by reference. Because the Services are hosted by Shopify, Shopify also collects and processes personal information about your access to and use of the Services.

SECTION 12 — PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any applicable regulations, rules, laws or ordinances; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, harm, defame, disparage, intimidate or discriminate against our employees or any other person; (e) to transmit false or misleading information; (f) to upload or transmit viruses or other malicious code; (g) to send unsolicited advertising or spam; (h) to impersonate any person or entity; (i) to scrape, harvest or systematically extract data from the Services; or (j) to engage in any other conduct that restricts anyone's use or enjoyment of the Services, or which may harm AlginatePlus, Shopify or users of the Services, or expose them to liability.

SECTION 13 — DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

(a) Disclaimer. Except as expressly stated by us, and except in respect of rights you have as a consumer under applicable law, the Services and all products offered through the Services are provided "as is" and "as available", without representation, warranty or condition of any kind, express or implied, including all implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, durability, title and non-infringement. We do not guarantee, represent or warrant that your use of the Services will be uninterrupted, timely, secure or error-free.

Nothing in this section limits your statutory rights. UK consumers retain their rights under the Consumer Rights Act 2015. US consumers retain any rights under applicable state law and the Magnuson-Moss Warranty Act. Some jurisdictions do not allow the exclusion of implied warranties, so parts of the above may not apply to you.

(b) Limitation of liability. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under applicable product liability law, or for any other liability that cannot lawfully be excluded or limited.

Subject to the above, and to the fullest extent permitted by law, in no case shall AlginatePlus, our partners, directors, officers, employees, affiliates, agents, contractors, service providers or licensors, or those of Shopify and its affiliates, be liable for any indirect, incidental, punitive, special or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data or replacement costs, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Services or any products procured using the Services.

Where our liability is not excluded, our total liability to you in connection with any order will not exceed the amount you paid for that order.

SECTION 14 — DISPUTE RESOLUTION

This section applies differently depending on where you live.

14.1 If you are a consumer resident in the United Kingdom

Please contact us first at hello@alginateplus.com. We aim to acknowledge complaints within [X] working days.

Nothing in these Terms requires you to arbitrate or waives your right to bring a claim in court. These Terms are governed by the laws of England and Wales and you may bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings in the courts of your home nation.

14.2 If you are a consumer resident in the United States

PLEASE READ THIS SUBSECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

(a) Informal resolution first. Before commencing arbitration, you agree to contact us at hello@alginateplus.com with a written description of the dispute and the relief sought, and to allow 60 days for us to attempt to resolve it informally. We will do the same before initiating arbitration against you.

(b) Agreement to arbitrate. You agree that any dispute or claim arising from or relating to this arbitration provision, our Privacy Policy, our Terms of Service, our advertising or marketing practices, or our products or services shall be submitted to binding, final and confidential arbitration before a single arbitrator administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. This provision is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1–16, and the arbitrator shall be bound by its terms. The arbitrator shall have exclusive authority to determine whether a dispute or claim is arbitrable, except as stated in paragraph (c).

(c) Class action waiver. The arbitrator may only resolve disputes or claims between you and AlginatePlus individually, and may not consolidate claims or proceedings without our consent. The arbitrator may not hear class or representative claims or requests for relief on behalf of other individuals. If a court or arbitrator decides that any part of this agreement to arbitrate cannot be enforced as to a particular claim for relief or remedy, then that claim or remedy (and only that claim or remedy) must be brought in court and any other claims must be arbitrated. Enforceability of this paragraph is for a court, not the arbitrator, to decide.

(d) Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property rights. Nothing here prevents you from reporting a concern to any government agency.

(e) Costs and location. AAA's Consumer Arbitration Rules govern the allocation of filing and arbitrator fees. Arbitration will take place in the county where you reside, or by telephone, video conference, or document submission only, at your election.

(f) YOUR RIGHT TO OPT OUT. You may opt out of arbitration within 30 days of the date you purchased a product through our website by sending written notice to [SUPPORT EMAIL] with the subject line "Arbitration Opt-Out", stating your name, the email address used for your order, and your intent to opt out of arbitration. Opting out will not affect any other part of these Terms or your relationship with us.

(g) Survival. This subsection survives termination of your relationship with AlginatePlus.

14.3 Governing law

These Terms of Service and any separate agreements under which we provide you Services are governed by and construed in accordance with the laws of England and Wales. US customers who have opted out under 14.2(f) may alternatively bring proceedings in the courts of the state and county in which they reside.

If you are a consumer resident anywhere other than the UK or US, this choice of law does not deprive you of the protection of any mandatory consumer law provisions of your country of residence.

SECTION 15 — SEVERABILITY AND WAIVER

If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed. Such determination shall not affect the validity and enforceability of any remaining provisions.

Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of that right or provision.

SECTION 16 — CHANGES TO TERMS OF SERVICE

You can review the most current version of these Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting updates to our website, and we will update the "Last updated" date above.

Where a change materially affects your rights — including any change to Section 14 — we will give reasonable advance notice by email to the address on your account, and the change will not apply retroactively to any dispute of which we had notice before the change.

Your continued use of or access to the Services following the posting of changes constitutes acceptance of those changes.
